PERSONAL INJURIES
THEY WILL NOT SETTLE:
Insurance adjusters will not settle unless you present a good case and unless they believe you have the resolve to sue them. Pick a good lawyer and do the smart things early to make the case easier to win.
ACCIDENT & INJURY TIPS
At the time of the accident:
> Do not refuse medical treatment. Trauma and shock may mask your injuries.
> Do not make statements about liability or causation. Honest people sometimes make quick and incorrect assessments that later confuse and cause problems.
> A citation issued by authorities is not automatically a resolution of the issues. It does not guarantee one will win or lose a civil claim. The standards of proof are often different and further investigation often reveals that the authority's first impression was wrong.
> Be wary of adjusters that offer quick settlement checks. Some divide the case into property damages and medical damages (pain and suffering, lost wages and medical bills). The way you settle one could affect the other.
> Pick a serious law firm to represent you. One that is willing to litigate to get a fair settlement. Make sure your lawyer is not afraid or inclined to go to trial.
> Understand what a contingent fee agreement will mean. Will your lawyer seek a quick settlement without trial? Will he only give you minimum contact while the matter progresses? Will an assistant or paralegal do the work on your case?
> Know your damages before you give him the case to help you receive fair compensation for your injuries. Be wary of those that boost your expectations.
